Another year is in the books. How did it pass so quickly? It seems like it was just yesterday that we were welcoming in 2015. All I can chalk it up to is the fact that we’re enjoying what we do now more than ever.
This year, as a firm we served more clients than in any previous year and we feel honored to have played an important role in obtaining some tremendous results.
One case that stands out involved an elderly widow suffering from advanced dementia, whose neighbors convinced her to sign over title to her home to them. Our client, a relative of the widow, requested that the District Attorney’s office prosecute the neighbors, but was told this was a “civil matter”. We immediately filed a lawsuit alleging financial elder abuse by the neighbors and simultaneously filed a lis pendens against the property, protecting it from being sold by the neighbors or used as collateral for a loan. After only a few months of litigation, we obtained a complete settlement that restored the property to the elderly widow.
Unfortunately, cases like this are becoming increasingly common, with predators (typically “friends”, family members, caretakers, or neighbors) taking advantage of elderly individuals’ decreased mental functions. Fortunately, California has some of the strongest legal protections for elders in the country, and we find tremendous fulfillment in using those laws to protect elders against financial abuse.
